Terms of Service

These terms govern your access to and use of Calldone, an AI voice agent platform that places and receives real phone calls on your behalf, and that gives you tools to message your own contacts through your own messaging provider. Please read them carefully.

Last updated: August 6, 2026

By clicking “I accept,” creating an account, or otherwise accessing or using Calldone, you confirm that you have read and understood, and agree to be bound by, these Terms of Service. If you are accepting on behalf of a company or organization, you represent that you have the authority to bind that organization. If you do not agree to these Terms, you are not authorized to use the service.

These Terms of Service are an agreement between Anchor Ashland Desert LLC, a Florida limited liability company with its principal place of business at NW 8th Street, Fort Lauderdale, FL 33311, USA (“Calldone,” “we,” “our,” or “us”), and you (“you,” “your,” or “Customer”), and govern your use of the Calldone website at calldone.ai, our dashboard, our APIs, and our AI voice agent services (collectively, the “Services”). Calldone is a product of Anchor Ashland Desert LLC; where these Terms say “Calldone,” the party bound is Anchor Ashland Desert LLC. Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Together these documents form the “Agreement.”

1. Our Services

Calldone provides both the technology and the team that puts it to work. The technology is a platform for building, deploying, and managing AI voice agents that place and receive real phone calls. Through the platform you can create agents, provision or connect phone numbers, run outbound and inbound call flows, manage contacts and deals, connect your own messaging provider to text or email those contacts, connect third-party tools and integrations, and review call history, recordings, transcripts, and analytics.

1.1 Implementation services. Unless we agree otherwise, our team performs the initial build and launch of your AI agent as part of the Services: we gather your requirements, write and tune the agent’s prompts and knowledge base, configure your call flows, integrations, and phone numbers, and take the agent live with you. This work is performed at your direction and on the information you supply, and what we build for you is Customer Content under Section 8. You keep full visibility and control throughout: everything we configure is visible and editable in your dashboard, and you may change it at any time.

1.2 Implementation does not transfer responsibility. Because you decide what your agent says and who it contacts, our doing the setup work does not shift your obligations to us. You remain responsible for reviewing and approving what goes live, for supervising your agents once they are in service as described in Section 11, and for the calling, texting, consent, and disclosure requirements in Addendum 1. Calldone does not obtain consent on your behalf and does not warrant that any configuration we build satisfies the laws that apply to your use case.

1.3 Changes and availability. We may add, modify, or discontinue features over time. We use commercially reasonable efforts to keep the Services available, but we do not guarantee that they will be uninterrupted, timely, secure, or error-free.

2. Eligibility and Accounts

You must be at least eighteen years old and able to form a binding contract to use the Services. When you register, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account, including the activity of your team members. You must notify us promptly at [email protected] if you become aware of any unauthorized access to or use of your account.

3. Text Messaging

There are two different things that could be called “SMS” here, and they have different rules. This section covers both, and Section 4 of the Privacy Policy describes the same two in the same terms.

3.1 Text messages Calldone sends. Calldone sends text messages from its own platform number: appointment confirmations and appointment reminders, sent on behalf of the businesses that use Calldone, to those businesses’ own customers. Section 3.4 explains which number carries them and who the carriers treat as the sender, and Section 3.7 sets out the program disclosures — frequency, rates, STOP and HELP, and the fact that consent is never a condition of any service.

3.2 Messages about your own account come by email, not text. Everything we send you about your own account — email verification codes, password-reset codes, and account notices — is delivered by email. Two-factor authentication, if you enable it, uses an authenticator app on your device and sends nothing over SMS. We collect the phone number you give us at sign-up so we can reach you about your account and so support can verify who you are, not to text you.

3.3 Optional promotional messages. Sign-up offers an optional, unchecked box consenting to promotional text messages from Calldone. Ticking it is never a condition of creating an account, of purchasing anything, or of using any feature. We record that choice, but we are not sending promotional messages at this time. If we launch that program, messages will identify Calldone, message and data rates may apply depending on your carrier and plan, message frequency will vary, and every message will support replying STOP to stop and HELP for help. You can withdraw consent before then by writing to [email protected], and we will honor it.

3.4 Messages you send to your own contacts are yours, not ours. Calldone gives you tools to send SMS and WhatsApp messages to the contacts in your own workspace — manually, from a template, or automatically as an appointment confirmation, reminder, or sequence step. Whichever number carries them, you are the one who decides who is messaged and what it says, so you must have the recipient’s prior consent and you are responsible for compliance with the TCPA, the CAN-SPAM Act, and the requirements in Addendum 1. Calldone never obtains that consent on your behalf.

There are two ways those messages leave the platform, and they differ in who the carriers treat as the sender. If you have connected your own Twilio account, they are sent from your own sender number under your own carrier and A2P registration, and you are the sender of record: your campaign registration, your STOP and HELP handling, your opt-out language. If you have not connected one, they go out on Calldone’s platform number under Anchor Ashland Desert LLC’s own carrier registration. In that case we are the registered sender, we handle STOP and HELP on that number, and we may suspend or refuse sending for any workspace whose consent practices we cannot substantiate. That does not transfer your consent obligation to us — it only changes whose registration the traffic runs under.

3.5 What we do on the receiving side. When one of your contacts replies STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to a number you have connected, Calldone marks that contact’s consent as revoked and suppresses further sends to them from your workspace. This is a convenience, not a compliance guarantee: it only covers messages sent through Calldone, only for contacts we can match by number, and it does not relieve you of your own obligation to honor an opt-out however it reaches you.

3.6 Privacy of mobile numbers. Phone numbers and consent status — yours and your contacts’ — are never sold, and are never shared with third parties or affiliates for their own marketing or promotional purposes. No mobile information is shared with any third party for marketing under any circumstances. The only outside parties that receive a mobile number are the telecommunications and messaging providers that carry the message, and they receive it solely for that delivery. Our full data practices are in our Privacy Policy.

3.7 Program disclosures. These apply to every message that leaves Anchor Ashland Desert LLC’s platform number, and are stated here in one place so a recipient or a carrier can find them without reading the rest of this agreement.

  • Who sends. Messages identify the Calldone customer they are sent for, and are carried by Anchor Ashland Desert LLC.
  • What is sent. Appointment confirmations, appointment reminders, and replies to a conversation the recipient started. We do not send marketing on the platform number.
  • How often. Message frequency varies and depends on your own activity — typically one message per appointment booked, changed, or coming up.
  • Cost. Message and data rates may apply, depending on your carrier and plan. Calldone does not charge recipients for messages.
  • Stopping. Reply STOP to any message to stop them, or HELP for help. STOP is honored on the number that received it, and we suppress further sends to that number.
  • Consent is never a condition. Agreeing to receive text messages is not required to book an appointment, to receive any service, to complete any transaction, or to create or keep a Calldone account. Consent may be withdrawn at any time without affecting the underlying service.
  • Carriers. Wireless carriers are not liable for delayed or undelivered messages.
  • Your data. Mobile numbers and consent status are never sold and never shared with third parties or affiliates for their own marketing. See Privacy Policy Section 4.

4. Customer Responsibilities and Acceptable Use

You are solely responsible for your use of the Services, for all content and data you provide, for using the Services in compliance with applicable laws, and for maintaining the confidentiality of your account credentials.

You agree not to use the Services to violate any law or infringe anyone’s rights; to place unlawful robocalls or send spam, fraudulent, deceptive, or harassing calls or messages; to impersonate any person or organization or transmit misleading caller identification; to conceal that a caller is an AI agent where the law requires disclosure; to transmit malware or attempt to gain unauthorized access to any system; to interfere with the integrity or performance of the Services; to reverse engineer, resell, or exceed the rate limits of the Services except as expressly permitted; or to rely on the Services for emergency communications or any use where failure could lead to death, personal injury, or serious harm.

Your use of the Services for outbound calls, AI-generated voice communications, automated dialing, text messaging, and call recording is additionally subject to the requirements in Addendum 1 (Calling, Texting, and AI-Generated Voice Compliance), which forms part of this Agreement.

5. Payment Terms

Information about our plans is posted at calldone.ai/pricing. Calldone offers subscription plans that include usage allowances for different call types, along with a pay-as-you-go wallet for usage beyond those allowances. When you purchase a plan or add funds, you authorize us to charge your payment method for the applicable amounts, including any taxes. Subscriptions renew automatically for the period you selected until you cancel, and to cancel you must remove subscription-based items such as phone numbers, or close your workspace, before the end of the current period. Wallet funds are consumed as you use metered services such as calls, telephony, speech-to-text, language model, and text-to-speech usage. Phone numbers are not included in any plan: each number you provision is billed as its own recurring subscription, in addition to your plan, and is released if that subscription is cancelled or a payment fails. Payments are processed by Stripe. Except where the law requires otherwise, all fees and consumed usage are non-refundable. We may change our rates by posting updated pricing, and the new rates apply to your next billing cycle.

6. Phone Numbers and Telephony

Phone numbers provisioned through Calldone come from carrier partners such as Twilio, Telnyx, or Vonage, or from a SIP or PBX connection you configure. These numbers are subject to the terms and availability of those carriers and may be reclaimed if the associated subscription lapses. You agree to use any phone numbers in compliance with the telecommunications laws that apply to you.

7. Calling and Recording Compliance

You are responsible for ensuring your use of AI voice agents complies with all applicable laws, including the Telephone Consumer Protection Act, Do-Not-Call rules, telemarketing regulations, and call-recording and wiretap laws, which vary by jurisdiction. Where required, you must disclose to callers that they are interacting with an AI agent and that the call may be recorded, and you must obtain any consent needed before contacting people or recording conversations. If you enable call recording, you permit Calldone to process the resulting audio and transcripts to run the call, to produce your transcripts, summaries, and analytics, and to tune the agents in your own workspace. We do not train, fine-tune, or otherwise build AI models on your calls, and we do not use one customer’s calls to improve another’s agents. Section 2 of the Privacy Policy sets this out in full. Nothing in this section reduces your obligations under Addendum 1 or applicable law.

8. Your Content and Data

You retain ownership of the content you provide, including prompts, knowledge base material, contact lists, and the recordings and transcripts your agents generate (“Customer Content”). You grant Calldone a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Customer Content solely to provide, support, and secure the Services for you, as described in our Privacy Policy. That license does not extend to training AI models on Customer Content or to using it for any other customer’s benefit. You represent that you have all rights and permissions necessary to provide Customer Content and to have it processed by Calldone and its providers. You must not upload data subject to heightened legal protection, such as protected health information under HIPAA, payment card data under PCI DSS, or biometric identifiers, unless we have expressly agreed in writing to receive it.

9. Third-Party Services

The Services work together with third-party providers for telephony, speech-to-text, text-to-speech, language models, payments, and optional integrations such as Slack, Google Sheets, Google Calendar, GoHighLevel, Make, and custom webhooks. When you use a feature powered by one of these providers, your use may also be governed by that provider’s terms, and Calldone is not responsible for their acts or omissions.

10. Intellectual Property

The Services, including all software, designs, models, algorithms, and content we provide, other than Customer Content, are owned by Calldone and its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes. You may not copy, modify, create derivative works from, reverse engineer, resell, or use the Services to build a competing product, and you may not use our names, logos, or marks without our prior written consent. Any feedback you provide about the Services may be used by Calldone without restriction or obligation to you. We may collect and use aggregated, de-identified operational data derived from use of the Services — counts, durations, error rates, and similar measurements — to operate and improve them, provided such data cannot reasonably be used to identify you or any individual. This does not include the substance of your calls: recordings, transcripts, prompts, and knowledge base content are not used to train AI models, in aggregate or otherwise.

11. AI-Generated Output

Our agents use automated speech recognition and large language models to hold conversations and generate content, including voice output, transcripts, and summaries. AI-generated output can be inaccurate, incomplete, or unsuitable for a particular purpose, and it may be similar to output generated for other customers. You are responsible for configuring, testing, and supervising your agents, and for any decisions or actions taken based on their output. That remains true where Calldone performs setup work for you under Section 1: configuration we carry out at your direction is subject to your review, and you are responsible for the agents you put into service and for what they say on your behalf. Calldone retains ownership of the underlying models and grants you a license to use the AI-generated output for your internal business purposes, subject to these Terms.

12. Service Availability

Calldone will use commercially reasonable efforts to maintain a high level of availability for the Services, excluding scheduled maintenance and events beyond our reasonable control. Any specific service-level commitments, if offered, will be set out in a separate agreement.

13. Data Security and Privacy

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect Customer Content against unauthorized access, use, or disclosure, including encrypted connections, hashed credentials, and access controls. You remain responsible for securing your own credentials and for all activity under your account. No system is perfectly secure, and we cannot guarantee absolute security. Unless we have expressly agreed in writing, Calldone does not act as a HIPAA Business Associate and you must not use the Services to process regulated health information.

14. Warranty Disclaimer

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted or error-free, or that every call will connect or every message will be delivered. Some jurisdictions do not allow the disclaimer of certain warranties, so some of these disclaimers may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, Calldone and its suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, or data, even if advised of the possibility of such damages. Our total aggregate liability for all claims under this Agreement will not exceed the greater of the amount you paid for the Service that gave rise to the claim in the twelve months before the liability arose, or one hundred dollars if you are using the Services under a free or unpaid arrangement. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Calldone and its officers, directors, employees, and agents from any losses, costs, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Services, your content, your calls or messages, your violation of this Agreement or the rights of any third party, or your violation of any applicable law, including the TCPA or similar statutes. Calldone will defend you against third-party claims that the Services, used in accordance with this Agreement, infringe that party’s intellectual property rights, except where the claim arises from your content, your modifications, or your use of the Services in breach of this Agreement.

17. Suspension and Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach this Agreement, fail to pay fees when due, or use the Services in a way that creates risk or harm to us, other users, or third parties. We have the right, but not the obligation, to monitor and investigate suspected violations and to cooperate with law enforcement where criminal activity is suspected. On termination, your right to use the Services ends, and we may delete Customer Content after a reasonable period, subject to legal retention requirements.

18. Changes to These Terms

We may modify these Terms from time to time. When we make a material change, we will update the date at the top of this page and, where appropriate, provide notice. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms. The most current version supersedes all prior versions.

19. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact us in writing at the address in Section 21 and to negotiate in good faith for sixty days. Any dispute not resolved through negotiation will be subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida, and you consent to venue and personal jurisdiction there. To the extent permitted by law, you and Calldone each agree that disputes will be resolved on an individual basis and not as part of a class or representative action, and each waive any right to a jury trial.

20. General

If any provision of these Terms is held unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will stay in effect. You may not assign this Agreement without our prior written consent; we may assign it in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. Our failure to enforce any provision is not a waiver of it. In the event of a conflict between these Terms and any order form or separate agreement, these Terms control unless that document expressly states otherwise.

21. Contact Us

If you have any questions, concerns, or complaints regarding the Services or this Agreement, please contact us. Written notice under this Agreement, including the pre-suit notice required by Section 19, must be sent to the postal address below.

Addendum 1 — Calling, Texting, and AI-Generated Voice Compliance

This Addendum is incorporated into and forms part of the Terms of Service. Capitalized terms not defined here have the meanings given in the Terms. In the event of a conflict between this Addendum and the main Terms regarding outbound calling, texting, or AI-generated voice, this Addendum controls.

1. Scope. This Addendum applies to all use of the Services involving outbound telephone calls, AI-generated voice communications, automated dialing, or text messaging, including appointment reminders, lead qualification, notifications, and any other voice or messaging functionality provided through the platform.

2. Regulatory framework. The Services are subject to the Telephone Consumer Protection Act (47 U.S.C. § 227), FCC regulations at 47 C.F.R. § 64.1200, the FTC’s Telemarketing Sales Rule, and applicable state telemarketing and consumer protection laws (collectively, “Telecom Laws”). You are solely responsible for compliance with all Telecom Laws applicable to your use case, industry, and geographic reach.

3. AI-generated voice classification. The FCC has confirmed that AI-generated voices, including synthetic speech, voice cloning, and text-to-speech output, constitute an “artificial or prerecorded voice” under the TCPA. Calls made using AI voice agents are therefore subject to the same consent requirements as traditional robocalls and prerecorded calls. You may not place AI-generated voice calls without first obtaining the consent required under applicable Telecom Laws.

4. Consent requirements. Telemarketing or advertising calls to wireless or residential lines require the called party’s prior express written consent, which must clearly disclose that the consumer agrees to receive calls using an artificial or prerecorded voice (which may include AI-generated voice), identify the entity authorized to call, state that consent is not a condition of purchase, and be signed by the consumer. Non-marketing informational calls, such as appointment reminders and account alerts, require prior express consent, which may be established when a consumer provides a telephone number in connection with a transaction and the call relates to that transaction. You are solely responsible for obtaining, documenting, and retaining evidence of valid consent. Calldone does not obtain consent on your behalf.

5. AI disclosure to recipients. You must configure AI voice agents to identify, at the start of each outbound call, the business on whose behalf the call is made and the purpose of the call, and, where required by law, to disclose that the voice is artificially generated. You must not mislead any consumer about the artificial identity of an AI voice agent, and you are responsible for monitoring FCC rulemaking (including Docket No. 23-362) and adjusting your practices accordingly.

6. Do-Not-Call compliance. If you make telemarketing calls, you must scrub your call lists against the National Do-Not-Call Registry at least every 31 days and maintain an active subscription. You must also maintain an internal suppression list of people who have asked not to be contacted, honor those requests within a reasonable time, and keep entity-specific suppression lists where required.

7. Calling hours. You may not initiate calls before 8:00 a.m. or after 9:00 p.m. in the called party’s local time, unless you have their prior express consent to call outside those hours. Some states impose narrower windows, and you are responsible for determining and complying with the applicable hours for each jurisdiction you contact.

8. Consent revocation. Consumers may revoke consent by any reasonable method, including verbal statements during a call such as “stop calling,” “take me off your list,” or “unsubscribe.” You must configure your agents to recognize and honor these requests, add the number to your suppression list within a reasonable time, and refrain from further contact. For SMS, replying STOP revokes consent, and you must honor it immediately.

9. State laws. In addition to federal requirements, you must comply with the telemarketing and consumer protection laws of the states into and from which your calls and messages are placed. Calldone does not warrant that use of the Services satisfies any particular state’s law.

10. Call recording and two-party consent. If you enable call recording, you must disclose the recording and obtain any consent required under applicable law before or at the start of the call. In all-party consent states, you must configure your agents to announce recording and obtain verbal consent.

11. Caller ID. You may not transmit misleading or inaccurate caller identification information in violation of the Truth in Caller ID Act.

12. Retention of consent records. You must retain records of consent, including the method, date, and time consent was obtained, the disclosure presented, and the number for which consent was given, for at least five years or such longer period as the law or a litigation hold requires. Calldone does not store consent records on your behalf.

13. Data minimization. When uploading contact lists for outbound campaigns, provide only the data elements necessary for the campaign, such as phone number, name, and appointment time, and do not upload sensitive personal information such as government identifiers, financial account numbers, or health information.
